in the terms and conditions of the

Declaration for Springwood Ponds,

Condominium No. 106 (henceforth

the Declaration) dated March 20,

1991 and recorded in the office

of the County Recorder in and for

Dakota County, Minnesota on April

9, 1991 as Document No. 980241,

which said Declaration covers the

following described property situated

in the County of Dakota and State of

Minnesota, to-wit:

Unit No. 39, Condominium No. 106,

Springwood Ponds, a condominium

according to the plat thereof on file or

of record in the Office of the Dakota

County Recorder, Dakota County,

Minnesota.

WHEREAS, pursuant to said

Declaration, there is claimed to be

due and owing as of the date of this

Notice by Stacey Cain as unit owner

to Springwood Ponds Homeowners

Association, the principal amount of

Dollars and No/100 ($2,803.00) for

condominium assessments through

August, 2019; and no action being

now pending at law or otherwise to

recover said debt or any part thereof,

and;

WHEREAS, pursuant to said

Declaration, and the statute in such

case made and provided, said debt

personal representatives or assigns,

is six (6) months from the date of said

TIME AND DATE TO VACATE

PROPERTY: If the real estate is

an owner-occupied single family

dwelling, unless otherwise provided

by law, the date on or before which

property if the lien is not reinstated

under section 580.30 or the property

is not redeemed under section

(CHARLTON ROAD IMPROVEMENTS)

NOTICE is hereby given that the City Council of Sunfish Lake, Minnesota, will hold a public hearing at St. Anne’s

Episcopal Church located at 2035 Charlton Road (Highway 62 and Charlton Road), Sunfish Lake, Minnesota, at

7:00 p.m. on Tuesday, October 1, 2019, to consider, pass upon, adopt and levy the proposed special assessments

GENERAL NATURE OF IMPROVEMENTS:

City Project No. 2018-01 (the Project) involves the reconstruction and surfacing of the entire length of Charlton

Road from CSAH 63 (Delaware Avenue) to Highway 62 and softening the 90-degree curve. City Project No. 2018-

TOTAL AMOUNT OF PROPOSED ASSESSMENT:

The total project cost for Project 2018-01 is $964,491.85 (say $964,492), without the cost of the Wetland Enhancement.

The total amount of the proposed assessments is about 35% thereof, namely, the sum of $337,900.

The Project is proposed to be specially assessed against buildable tax parcels either abutting or served by said

improvements. The areas and parcels, as specifically described herein, are subject to said special assessments.

The buildable tax parcels abutting or served by the improvements are proposed to be assessed $10,900 per

buildable tax parcel for those tax parcels abutting or served by Charlton Road. The methodology also takes into

account an additional per unit assessment for institutional use that has additional traffic generation. This proposed

assessment per unit is approximately the same amount that was identified at the time of the public improvement

hearing in June 2018.

The cost of the Wetland Enhancement is $40,532.90. The cost of $40,532.90 is not proposed to be assessed;

rather, it is proposed that this be paid out of the general tax levy.

ASSESSMENT ROLL AVAILABLE FOR INSPECTION:

The proposed assessment roll is now on file with the City Clerk and City Treasurer and is open for public

inspection at St. Anne’s Episcopal Church at 2035 Charlton Road (Highway 62 and Charlton Road), Sunfish Lake,

Minnesota. The assessment roll is open for public inspection and is being mailed to all the above identified record

owners of the parcels proposed to be assessed. The assessment roll will also be available for examination at the

hearing.

OBJECTIONS AND APPEALS:

Written and oral objections will be considered at the hearing. Minnesota Statutes § 429.061 states that no

appeal may be taken as to the amount of the assessment unless a written objection signed by the affected property

5(b) or 5(c)], as stated in the person’s military order’s, for whom it would be a hardship to make the payments.

When deferment of the special assessments has been granted and is terminated for any reason provided by

law, all amounts accumulated, plus applicable interest, become due. Any assessed property owner meeting the

requirements of this law may apply to the City Clerk on the prescribed form for such deferral or payments of these

AUTHORITY TO SPECIALLY ASSESS:

The proposed assessments are to be levied pursuant to Minnesota Statutes, Chapter 429. The improvements

are proposed to be assessed against the buildable unit tax parcels abutting or served by the improvements. The

areas, parcels, lots and pieces or property, as specifically described herein, are subject to said assessments. The

amounts set forth in this Notice are the proposed assessments. The City Council may levy and adopt special

assessments that are the same or different than the proposed amounts.

PAYMENT OF SPECIAL ASSESSMENTS:

Once the special assessments are levied and adopted, the special assessments will be certified to the

Dakota County Auditor to be extended on the property tax lists for collection with real estate taxes. Prior to this

certification, however, the property owner may prepay the entire amount of the assessments without any interest

thereon provided the prepayment is received by November 15, 2019. If the property owner wishes to prepay the

special assessments without any interest, then such payment must be made to the City of Sunfish Lake at the

City Treasurer’s Office, Attention: Ann Lanoue, 8010 Corey Path, Inver Grove Heights, Minnesota 55076. Partial

pre-payment of the special assessment is not presently allowed under the City ordinances; the prepayment, without

interest, must be for the entire amount of the special assessments.

a.) the total principal amount of the special assessments will be divided into an equal number of annual

installments. The proposed number of annual installments is ten (10). The number of annual installments will be

decided by the City Council when the special assessments are levied.

b.) The principal amount of the special assessments shall bear interest at the rate determined by the City Council

when the special assessments are levied. The proposed interest rate is 4.2%.

c.) Interest is proposed to begin to accrue from and after January 1, 2020.

d.) The annual principal installments, together with interest accrued on the unpaid balance, are due and payable

together with real estate taxes.

e.) Interest on the entire special assessments, from January 1, 2020, to December 31, 2020 (the year in which

the first installment is payable), is added to the first principal installment. The first installment will be due and

payable in 2020.

f.) If in the future the property owner wishes to pay off the remaining balance of the assessments, then Minnesota

Statutes § 429.061, subd. 3 provides that such payment be made to the City Treasurer or to the Dakota County

Auditor Treasurer, together with interest accrued to December 31 of the year in which payment is made as long as

payment is made prior to November 15th; if the payoff occurs after November 15th, then interest for the next year

is also added.

If the adopted special assessments differ from the proposed assessments as to any particular lot, piece or parcel

of land, then the City will mail to the owner a notice stating the amount of the adopted assessments. Owners

will also be notified, by mail, if the City Council adopts any changes in the interest rate or prepayment requirements

SOUTH ST. PAUL BOARD OF EDUCATION MEETING

Monday, August 26, 2019

Regular Meeting Summary

The regular meeting of the School Board for Special School District No. 6, South St. Paul, was called to order at

7:15 PM in the Council Chambers at City Hall on Monday, August 26, 2019.

The members of the South St. Paul School Board and audience recited the Pledge of Allegiance.

A motion passed approving this evening’s meeting agenda and the minutes from the previous meeting.

Reports:

• IB Diploma Program Update: Learning Director Chad Schmidt provided some highlights of the District’s IB

Diploma program that has been in place since 1987. In 2019, more than 300 students enrolled in at least one IB

DP course and collectively completed over 350 exams. There was a 46% increase in IB DP course enrollments and

over 350 IB DP examinations, which exceeds our own 5-year average by 25 exams.

• MDHR Update: Superintendent Webb highlighted the district’s work with Minnesota Department of Human

Rights (MDHR) to address issues related to disparities in student discipline rates that exist for students of color and

students with disabilities. Administration was pleased to share that suspension rates over the course of last year,

declined across the district and attributes these results to their work with MDHR and the strategies and frameworks

that are being utilized to create positive learning environments.

• 2018-19 Superintendent Evaluation Update: Chair Chris Walker provided the following review of Superintendent

Dave Webb’s evaluation for 2018-19: “The evaluation highlighted the continued development of personalized

learning for every child in our district, the changes made in response to the community’s concerns about behavior in

the schools, and Dr. Webb’s engagement with the community and legislature aimed at addressing the needs of our

district and Minnesota schools in general. It was a successful school year and we all look forward to the 2019-2020

year.”

• Listening Session Report for August 12, 2019: Two individuals addressed the School Board regarding the

listening session structure study and recommendations within the Student Rights and Responsibilities Handbook.

As a follow-up, Chair Walker reached out to the individuals regarding their comments and concerns.

• Superintendent’s Report: Superintendent Dave Webb provided highlights from around the District.

A motion passed approving the staffing and financials as presented.

A motion passed approving the Flexible Learning Days Plan.

A motion passed scheduling a special School Board meeting for Thursday, August 29.

A motion passed approving the Student Rights and Responsibilities Handbook

A motion passed approving the Resolution Approving Employment of the Board Clerk as a Substitute in a Classified

Position in a School District.

The School Board moved into a closed session per the open meeting law (Minn. Stat. § 13D) for the purpose of

negotiations.

The total project cost for Project 2018-01 is $964,491.85 (say $964,492), without the cost of the Wetland Enhancement.

The total amount of the proposed assessments is about 35% thereof, namely, the sum of $337,900.

The Project is proposed to be specially assessed against buildable tax parcels either abutting or served by said

improvements. The areas and parcels, as specifically described herein, are subject to said special assessments.

The buildable tax parcels abutting or served by the improvements are proposed to be assessed $10,900 per

buildable tax parcel for those tax parcels abutting or served by Charlton Road. The methodology also takes into

account an additional per unit assessment for institutional use that has additional traffic generation. This proposed

assessment per unit is approximately the same amount that was identified at the time of the public improvement

hearing in June 2018.

The cost of the Wetland Enhancement is $40,532.90. The cost of $40,532.90 is not proposed to be assessed;

rather, it is proposed that this be paid out of the general tax levy.

ASSESSMENT ROLL AVAILABLE FOR INSPECTION:

The proposed assessment roll is now on file with the City Clerk and City Treasurer and is open for public

inspection at St. Anne’s Episcopal Church at 2035 Charlton Road (Highway 62 and Charlton Road), Sunfish Lake,

Minnesota. The assessment roll is open for public inspection and is being mailed to all the above identified record

owners of the parcels proposed to be assessed. The assessment roll will also be available for examination at the

hearing.

OBJECTIONS AND APPEALS:

Written and oral objections will be considered at the hearing. Minnesota Statutes § 429.061 states that no appeal

may be taken as to the amount of the assessment unless a written objection signed by the affected property

owner is filed with the municipal clerk prior to the assessment hearing or presented to the presiding officer at the

hearing.

An owner may appeal an assessment to the District Court pursuant to Minnesota Statutes § 429.081 by serving

notice of appeal upon the Mayor or the City Clerk of the City within thirty (30) days after the adoption of the assessment

and filing such notice with the District Court within ten (10) days after service upon the Mayor or the City

Clerk.

SENIOR CITIZENS DEFERMENT:

Under Minnesota Statutes § 435.193 to 435.195, the Sunfish Lake City Council may, in its discretion, defer the

payment of these special assessments (a) for any homestead property owned by a person 65 years of age or

PAYMENT OF SPECIAL ASSESSMENTS:

Once the special assessments are levied and adopted, the special assessments will be certified to the

Dakota County Auditor to be extended on the property tax lists for collection with real estate taxes. Prior to this

certification, however, the property owner may prepay the entire amount of the assessments without any interest

thereon provided the prepayment is received by November 15, 2019. If the property owner wishes to prepay the

special assessments without any interest, then such payment must be made to the City of Sunfish Lake at the

c.) Interest is proposed to begin to accrue from and after January 1, 2020.

d.) The annual principal installments, together with interest accrued on the unpaid balance, are due and payable

e.) Interest on the entire special assessments, from January 1, 2020, to December 31, 2020 (the year in which

the first installment is payable), is added to the first principal installment. The first installment will be due and

payable in 2020.

f.) If in the future the property owner wishes to pay off the remaining balance of the assessments, then Minnesota

Statutes § 429.061, subd. 3 provides that such payment be made to the City Treasurer or to the Dakota County

Auditor Treasurer, together with interest accrued to December 31 of the year in which payment is made as long as

payment is made prior to November 15th; if the payoff occurs after November 15th, then interest for the next year

is also added.

If the adopted special assessments differ from the proposed assessments as to any particular lot, piece or parcel

thereof, namely, the sum of $85,734. The Project is proposed to be specially assessed against buildable tax

parcels either abutting or served by said improvements. The areas and parcels, as specifically described herein,

are subject to said special assessments. The buildable tax parcels abutting or served by the improvements are

proposed to be assessed $2,598 per buildable tax parcel for those tax parcels abutting or served by the Project.

ASSESSMENT ROLL AVAILABLE FOR INSPECTION:

The proposed assessment roll is now on file with the City Clerk and City Treasurer and is open for public

inspection at St. Anne’s Episcopal Church at 2035 Charlton Road (Highway 62 and Charlton Road), Sunfish Lake,

Minnesota. The assessment roll is open for public inspection and is being mailed to all the above identified record

owners of the parcels proposed to be assessed. The assessment roll will also be available for examination at the

hearing.

OBJECTIONS AND APPEALS:

Written and oral objections will be considered at the hearing. Minnesota Statutes § 429.061 states that no appeal

may be taken as to the amount of the assessment unless a written objection signed by the affected property

owner is filed with the municipal clerk prior to the assessment hearing or presented to the presiding officer at the

hearing.

An owner may appeal an assessment to the District Court pursuant to Minnesota Statutes § 429.081 by serving

notice of appeal upon the Mayor or the City Clerk of the City within thirty (30) days after the adoption of the assessment

and filing such notice with the District Court within ten (10) days after service upon the Mayor or the City

Clerk.

SENIOR CITIZENS DEFERMENT:

Under Minnesota Statutes § 435.193 to 435.195, the Sunfish Lake City Council may, in its discretion, defer the

SOUTH ST. PAUL BOARD OF EDUCATION MEETING

MONDAY,

REGULAR MEETING SUMMARY

The regular meeting of the School Board for Special School District No. 6, South St. Paul, was called to order at

7:15 PM in the Council Chambers at City Hall on Monday, September 9, 2019.

The members of the South St. Paul School Board and audience recited the Pledge of Allegiance.

A motion passed approving this evening’s meeting agenda and the minutes from the previous meeting.

Quality-in-Action

• Community Learning Center Assistant Principal Robin O’Reilly highlighted the summer programming that was

offered across the district. She also showcased the community murals that were done in partnership with local artist

Shane Anderson and organizations like the city of South St. Paul, Lions Club, and the SSP Educational Foundation.

This community-wide event was hosted by the Community Learning Center students who researched the history of

SSP to incorporate into the design of the murals. These murals, which were painted collaboratively by all ages of

our community, are displayed at the Doug Woog Arena.

Reports

• MN Assessment Results

Learning Director Chad Schmidt summarized our students’ performance on the 2019 Minnesota Accountability

Assessments. All students in grades 3-8 and once in high school are assessed in both mathematics and reading

every year. Additionally, science assessments are administered in grades 5, 8 and once in high school.

Highlights included: Lincoln Center (LC) is at/near MN average for math achievement and progress, SSP

Secondary is near MN average for reaching reading achievement, Kaposia (KEC) and LC are near/above MN

average for reading progress, the District, KEC and LC exceed MN average for progress towards English Language

Proficiency and SSP Secondary exceeds the MN average for 4-year graduation rates with 96%.

District and building leaders will continue to examine the data and develop strategies and systems like Multi-Tiered

Systems of Support (MTSS) to enable our students to continue growing in all areas.

• Superintendent’s Report:

Superintendent Dave Webb provided highlights from around the District.

A motion passed approving the staffing and financials as presented.

A motion passed scheduling a special School Board work session for Monday, September 16.

A motion passed approving the 2020-2021 Health Insurance Contract.

A motion passed approving the 2020 Health and Dental Insurance Rates.

A motion passed approving the Resolution Approving Purchase Agreement and Lease.

A motion passed approving the Acceptance of Gifts Resolution.

A motion passed designating Dave Webb, Superintendent of Schools, as the Identified Official with Authority

(IOwA) for South St. Paul Public Schools.

School Board members reported on various educational activities/events in which they have participated as well as

other informational items.

will hold a Public Hearing on

Wednesday, October 2, 2019 at

4.) An application for a Conditional

Use Permit and Site Plan for the

The applicant proposes to use the

existing building and site at 497

Farwell Avenue for a light truck repair

operation. The property is generally

located south of Armour Avenue,

5) A Public Hearing to consider

an Ordinance amending City Code

to reduce the minimum number of

required off-street parking spaces

for certain land uses. The land uses

under consideration for reduction

in the required number of minimum

off-street parking spaces are

generally commercial, institutional,

and multifamily uses. Single family

homes would not change under the

proposed ordinance.

6) An application by the City of South

St. Paul to consider an ordinance

amendment to the text of City Code

Section 118-129 regarding the

Industrial Zoning District, the types

of uses which would be permitted,

conditional, accessory, or prohibited,

and to consider dividing the

Industrial District into sub-districts.

The ordinance includes language

which would have the Industrial

district split into I-1: Light Industrial

(generally located north of Interstate

494, east of Concord Street, west

of the Mississippi River and south

of Hardman Avenue South) and

one or two other Industrial districts

(generally located south of Interstate

494, east of Concord Street, west of

the Mississippi River and north of the

City’s southern border).

A school board meeting was held

at 6:00 p.m. on Monday, September

9, 2019 in the Council Chambers

at the Mendota Heights City Hall,

1101 Victoria Curve, Mendota

Heights, MN. The following School

Board members were present: John

Chandler, Brenda Corbett, Stephanie

Levine, Joanne Mansur, Maureen

Ramirez, Byron Schwab and Terry

Stamman. Superintendent Peter

Olson-Skog was present.

A motion carried to approve the

main agenda.

A motion carried to approve

the consent agenda that

included minutes; personnel

recommendations; and July and

August 2019 wire transfers reports.

A construction update was provided.

A motion carried to approve the

Superintendent’s contract for July 1,

2020 through June 30, 2023.

strategic planning process and

timeline.
